Terms of service
The ground rules.
The short version. What you share is yours; you let us store it and show it to your group. Be decent to the people in your groups and don’t share anything illegal or harmful. Highlie is provided as is, and you can stop using it and delete your account whenever you like.
These terms are an agreement between you and Garrett Halls (“we”, “us”), who runs Highlie, the group newsletter app for iPhone and the web (the “Service”). By creating an account or using Highlie, you agree to these terms and to our privacy policy. If you don’t agree, please don’t use Highlie.
1. Who can use Highlie
You must be at least 13 years old to create an account. If you’re under the age of majority where you live, you need a parent or guardian’s permission, and they agree to these terms for you. You can’t use Highlie if the law where you live forbids it, or if we’ve previously removed you from it.
2. Your account
You sign in with Apple or Google, and you’re responsible for what happens under your account, so keep that sign-in secure. Use your real name or one the people in your groups will recognize. Tell us at support@highlie.com if you think someone else is using your account.
3. Groups
Whoever starts a group owns it. The owner can remove people, and if they leave, ownership passes to the longest-standing member. Any member can change a group’s schedule and look, invite people with a link, and leave at any time. Think about who you invite: everyone in a group can read every issue it publishes, including issues from before they joined.
4. What you share
It’s yours. You keep ownership of the updates, photos and comments you share (“your content”).
You let us use it to run Highlie. You give us a worldwide, non-exclusive, royalty-free license to store, copy, process, format and display your content, only as needed to provide the Service: for example, to put your update in your group’s issue, resize and convert your photos, check them for known child sexual abuse material, and show them to your group. This license ends when your content is deleted, except for issues already published to a group, where your stories stay (credited to “Former member” if you delete your account), and for copies kept for a limited time in backups, for handling reports, or because the law requires it, as the privacy policy describes.
You’re responsible for it. Only share content you have the right to share, and only share things about other people, especially children, that you’d be comfortable with everyone in the group seeing.
5. Rules
Don’t use Highlie to share, or to help anyone share, anything that:
- is illegal, or promotes illegal activity;
- sexually exploits or endangers children, in any way;
- harasses, bullies, threatens or abuses anyone, or promotes violence or hatred against people based on who they are;
- is sexually explicit, or shows graphic violence;
- shares someone’s private information, or intimate images, without their consent;
- infringes someone else’s copyright, trademark, privacy or other rights;
- is spam, a scam, malware, or impersonates someone else.
And don’t try to get into accounts, groups or data that aren’t yours, interfere with or overload the Service, or scrape, copy or reverse-engineer it except as the law allows.
6. Reporting, blocking and enforcement
You can report any story or comment, and block anyone, from within the app. We review reports within a day. We have zero tolerance for objectionable content and abusive users: if content or behavior breaks these rules, we may remove the content, remove the person from groups, suspend or delete their account, and, where the law requires or someone is at risk, report it to the authorities. We’re not able to monitor everything shared in private groups, and we’re not responsible for what other people share.
Child sexual abuse material. Photos are automatically checked against lists of known child sexual abuse material, as the privacy policy explains. If we find it, by that check or a report, we block it, keep it and the related account information as the law requires, report it to the National Center for Missing & Exploited Children (NCMEC), which works with law enforcement, and suspend the account, without warning.
7. Leaving Highlie
You can stop using Highlie and delete your account in the app at any time (Account → Delete account). We may suspend or end your access if you break these terms, if we’re required to by law, or if we stop offering Highlie, in which case we’ll give you reasonable notice where we can. Sections 4 (for content already published), 8, 9, 10 and 12 continue to apply after your account ends.
8. Highlie is provided “as is”
Highlie is free and made by an independent developer. We work hard to keep it running and your content safe, but we provide the Service “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that it will always be available, error-free or that content will never be lost, so keep your own copies of anything you can’t bear to lose.
9. Limits on our liability
To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of Highlie or content shared by others. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the past 12 months (currently nothing) or US$50. Some places don’t allow these limits, so they may not all apply to you; nothing in these terms limits liability that can’t be limited by law.
10. Indemnity
If someone brings a claim against us because of content you shared or your breaking these terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
11. Apple’s App Store
If you got Highlie from Apple’s App Store, these terms are between you and us, not Apple. Apple isn’t responsible for Highlie or its content, has no obligation to provide maintenance or support for it, and isn’t responsible for any claims relating to it (including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims); to the extent any warranty applies and Highlie fails to conform to it, you may notify Apple, and Apple will refund the purchase price, if any, which for Highlie is none. You confirm you’re not in a country subject to a U.S. government embargo or on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You also agree to follow Apple’s Media Services terms when using the App Store.
12. Disputes
If you have a problem with Highlie, please email us first at support@highlie.com; most things can be sorted out that way. These terms are governed by the laws of the State of Utah and applicable U.S. federal law, without regard to conflict-of-law rules, and any dispute will be heard in the state or federal courts located in Utah, unless the law where you live gives you the right to bring it in your local courts.
13. Changes
We may update these terms as Highlie changes. We’ll update the date at the top, and for significant changes we’ll tell you in the app before they take effect. If you keep using Highlie after that, you accept the new terms; if you don’t, you can delete your account.
14. Transfer
We may transfer these terms, and our rights and obligations under them, to a company we form or control to run Highlie, or to anyone who takes over Highlie, as long as they agree to honor these terms and the privacy policy. You can’t transfer your account or these terms to someone else.
